在本條款及條件中，「本公司」代表福雷貿易有限公司，而「顧客」代表任何透過本網站向本公司訂貨的人、商號、公司或團體。

請在使用本網站之前仔細閱讀本條款及條件。您使用本網站或其中任何部分，即表示同意您已閱讀本條款及條件，並且接受和同意受本條款及條件約束。

本條款及條件將受中華人民共和國香港特別行政區(「香港」)法律所管轄及按照香港法律解釋。顧客及本公司均同意香港法院對其具有專有司法管轄權。

年齡確認

根據香港法律，售賣酒精類飲品予18歲以下的人士為非法行為。訂貨代表該顧客確認自己年滿18歲或以上。顧客須確保其他人士不得使用其網頁登入戶口購買酒精類飲品，及確保收貨時必須由一名年滿18歲或以上人士(須提供適當證明) 收貨。如上述人士並不在場，本公司將會收回貨品並會嘗試於另一約定時間再行送貨。

訂單

所有試酒筆記、貨品味道說明、一般清酒資料、評論、意見及美食配對建議(統稱「有關評論」) 均為本公司的主觀意見。本公司就有關評論的準確性或完整性不作申述，顧客亦不可以有關評論作為訂購要求的倚據。

顧客透過sakeguru.store提出的訂購要求須被本公司接受才生効。由本公司或其代理人將清酒送往指定的地址便証實本公司接受了該訂購要求。確認收到訂購要求的電郵不可被視為訂購要求已被接受的証明。

本公司保留以下權利:

  • 如任何訂購的貨品或服務未能被提供，拒絕該訂單; 及
  • 限制銷售量及拒絕接受任何訂單(或該訂單的部分) ，包括有權拒絕售賣予任何顧客。

倘若本公司無法提供您訂單上的任何產品或服務，我們會於您所要求的交貨日期之前透過電話或電郵通知您。

本公司有權隨時更改本網站內的所有資料而不作另行通知。

註冊

透過本網站訂貨前，顧客必須先註冊帳戶。註冊的時候，顧客須:

  • 按要求提供給我們準確、完整及最新的註冊資料;
  • 確保妥善保存您的使用者名稱及密碼; 及
  • 授權我們假設只有您或您授權的人士使用您的使用者名稱及密碼登入本網站。

本公司有絕對酌情權，基於任何原因，拒絕任何新客户之註冊，及於任何時候終止任何已註冊之客户。

如您所註冊的資料有任何更改，須立即通知我們以確保我們能夠有効地聯絡您。

所有權

本公司保留貨品的所有權，直至有關貨品的價款全數結清為止。

貨品的所有風險在貨品送抵後轉移給顧客。

本公司有權處理該貨品，而無須再通知該顧客，如果以下列情況發生:

  • 由於顧客沒有通知本公司更改地址，或本公司不能成功聯絡顧客，已購買之貨品無法成功派送達兩星期; 或
  • 顧客拒絕收取貨品及不於七日內要求退款。

在上述情況下，本公司就該貨品的處理，無須向該顧客承擔法律責任。

付款方法

本公司接受下列付款方法:

  • VISA卡、萬事達卡及美國運通信用卡透過Shopify Payments系統付款；
  • Payme；
  • FPS轉帳；及
  • 送貨時以現金付款。

所有貨品之列價均為港幣。

本公司保留權利於任何時間更改網上購物的付款方式而不作另行通知。

其他

如由於不可抗力，如天災、火災、水災、意外、暴亂、戰爭、政府介入、禁運、罷工、勞工問題、設備故障或任何本公司不能控制的情況而引至延遲或未能提供服務，本公司均不會承擔任何責任。

本公司有權隨時修改本條款及條件，而無須事前通知。如有任何爭議，本公司的決定為最終的決定。

倘若本條款及條件有中文譯本，如中、英文本之文義有異，應以英文本為準。

如有任何爭議，本公司(即 福雷貿易有限公司)保留最終決定權。

免責聲明

本公司及其相聯公司、附屬公司、僱員、代理人、承辦商及任何第三方供應者(下統稱「Sake Guru」)不對下列事宜作出申述或保證：

  • store或本伺服器或任何其他sakeguru.store伺服器所儲存或取得的所有資料(下稱「有關資料」)的完整性、質量、運作、使用、準確性或時效，或對任何目的之適合性或用途；
  • 透過store或根據有關資料索取、提供或獲得之任何貨品或服務；
  • 瀏覽store或有關資料時不受干擾，或資料正確無誤，或有關資料不含任何電腦病毒或不具污染性或破壞性；

顧客不可以有關資料作為倚據。Sake Guru對顧客因倚據或使用有關資料或本網站而蒙受的任何間接或直接的損害、損失、費用或開支，均不承擔任何責任。

 

In these terms and conditions, the "Company" will mean Fortune Thunder Trading Company Limited and the "Customer" will mean any person, firm, company or body which places an order with the Company through this website (sakeguru.store).

Please read these terms and conditions carefully before using the site. By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and the Company agree to submit to the exclusive jurisdiction of the Hong Kong courts.

Confirmation of Age

Under the law of Hong Kong, it is illegal to sell alcohol to people under the age of 18. By placing an order, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.

Orders

All tasting notes, product taste descriptions, general sake information, commentaries, advice and food pairing suggestions (collectively, the “Commentary”) are subjective opinions of the Company. The Company makes no representations as to the accuracy or the completeness of the Commentary and the Customers shall not rely on the Commentary in making any offer for purchases.

The Customer’s offer to purchase made through sakeguru.store are subject to acceptance by the Company. Acceptance by the Company shall be evident by the delivery of the sake to the designated address by the Company or its agent. Confirmation of order placement by e-mail shall not be regarded as acceptance of the Customer’s offer to purchase.

The Company reserves the right to:

  • reject the order in the event that any of the products or services requested are unavailable; and
  • limit sales and refuse to accept any order (or part of the order), including the right to decline sales to any Customers.

In the event that the Company is unable to fulfill any of the products or services in the Customer’s order we will notify you by phone or email before your requested delivery date.

All information presented on this website are subject to change without prior notice to the Customers.

Registration

The Customer shall register before placing any order through this website. During the registration, the Customer shall:

  • provide us with accurate, complete and up to date registration information;
  • safeguard your username and password; and
  • authorise us to assume that any person using the site with your username and password is either you or is authorised to act for you.

The Company has the absolute discretion to refuse registration of a potential customer and to terminate, at any time, the registration of any customer for any reason whatsoever.

You must inform us immediately of any changes to the information that you provided so that we can communicate with you effectively.

Ownership

The Company shall retain title in the products until full payment has been received.

All risks in the products shall pass to the Customer upon delivery.

The Company has the right to dispose of the goods with no further notice to the Customer in the event that:

  • the goods are non-deliverable within two weeks of purchase due to Customer's failure to notify the Company of change of address or the Company is otherwise unable to contact the Customer; or
  • the Customer refuses to take delivery of the goods and does not apply for a refund within 7 days.

The Company shall have no liability to the customer in respect of disposal of the goods in such circumstances.

Payment

The Company accept payment by:

  • VISA, MasterCard and American Express through Shopify Payments system;
  • Payme;
  • FPS; and
  • Cash payment upon delivery.

All product prices listed are in Hong Kong dollars.

The Company reserves the right to change the payment terms for any order without prior notice.

Others

The Company shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of Company.

The Company may revise these terms and conditions at any time without prior notice. If any dispute arises, the Company’s determination shall be final.

Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.

Should there be any disputes arise, the Company (the Fortune Thunder Trading Company Limited) reserves the right of final decision.

Disclaimer

The Company and its associated companies, subsidiaries, employees, agents, contractors and any third party provider (collectively "Sake Guru") make no representation or warranty in relation to:

  • the completeness, quality, operation, use, accuracy, or timeliness of, or the fitness or use for any purpose of, sakeguru.store or the information (the “Information”) stored on or receivable through this or any other sakeguru.store server;
  • any goods or services accessed, offered or obtained through sakeguru.store or pursuant to the Information;
  • the access to sakeguru.store or the Information will be uninterrupted or does not contain any viruses, or contaminating or destructive properties.

The Customer shall not rely on the Information. Sake Guru shall not be liable for any damages, loss, costs or expenses arises, directly or indirectly, from the Customer’s reliance or use (whether authorized or not) of the Information or this website.
